Terms of service
These terms apply when you buy from Arc & Story through this website. Please read them before you order: they explain who we are, how we'll deliver your chair, what to do if something goes wrong, and your rights. They don't affect your legal rights as a consumer.
1. About us
This website is operated by [CONFIRM : ENT-01 · raison sociale ou nom du commerçant], trading as Arc & Story. [CONFIRM : ENT-02 · forme juridique, numéro Companies House et pays d'immatriculation (England and Wales, Scotland ou Northern Ireland)]. Our registered office is at [CONFIRM : ENT-03 · adresse du siège social]. [CONFIRM : ENT-05 · numéro de TVA, si immatriculé]
You can contact us by email at [CONFIRM : SAV-01 · adresse e-mail du service client], by [CONFIRM : SAV-02 · téléphone ou WhatsApp], or by post at [CONFIRM : ENT-04 · adresse géographique au Royaume-Uni].
When we write to you, we'll use the email or postal address you gave us with your order.
2. Who these terms are for
- These terms are for consumers buying for personal use.
- You must be at least 18 to place an order.
- We sell to delivery addresses in the areas listed on our Delivery page.
3. Our products
- Measurements : we measure the chair ourselves and publish the results on the product page, in cm and inches. Small variations can occur between chairs.
- Colours : we photograph each colour in daylight without changing the shade, but every screen shows colour a little differently.
- Use : the chair is adult seating for use indoors at home. It is not a sleep surface for a baby and not a toy. Please read section 10 and the safety information on the product page.
4. How the contract is made
- When you place an order, we'll email you to confirm we've received it. This email doesn't mean we've accepted your order yet.
- Our acceptance takes place when we email you to confirm that your order has been dispatched. That's when the contract between us is formed.
- If we can't accept your order — for example, because the chair is out of stock, we can't deliver to your address, or there's an obvious error in the price — we'll tell you and won't take payment. If we've already taken payment, we'll refund it in full.
5. Prices and payment
- Prices are in pounds sterling. [CONFIRM : PAY-03 · immatriculation à la TVA ; si oui : « Prices include VAT at the current rate. »]
- The delivery cost, if any, is shown before you pay. See our Delivery page.
- Pricing errors : if a price is obviously wrong, we'll contact you before dispatch. You can then confirm the order at the correct price or cancel it for a full refund.
- Payment : we accept [CONFIRM : PAY-01 · moyens de paiement acceptés]. Payment is taken when you place your order.
- Paying in instalments : if you choose [CONFIRM : PAY-02 · Klarna ou Clearpay, nombre d'échéances, conditions], your instalment agreement is with that provider, on its own terms. It doesn't change your rights against us.
6. Delivery
- Our Delivery page explains where we deliver, the cost, and the usual timescales.
- If we haven't agreed a date with you, we'll deliver without undue delay and no later than 30 days after the contract is formed.
- If something outside our control delays your order, see section 12.
- Risk : the chair is your responsibility from the moment it's delivered to you, or to someone you've named to receive it.
- Ownership : the chair becomes yours once we've received full payment.
7. Your right to cancel
You have 14 days from the day your chair is delivered to change your mind, for any reason. This is your legal right under the Consumer Contracts Regulations 2013. How to cancel, who pays for the return and when you'll be refunded are set out on our Returns page, which forms part of these terms.
8. If your chair is faulty or not as described
If the chair arrives damaged or faulty, your rights under the Consumer Rights Act 2015 apply. In summary, the chair must be as described, of satisfactory quality and fit for its purpose. Our Returns page explains what you can ask for and when. For detailed information, visit the Citizens Advice website or contact the Citizens Advice consumer helpline.
9. Our guarantee
[CONFIRM : GAR-01 · garantie commerciale : durée, ce qui est couvert, conditions, financement fournisseur, procédure de réclamation, garant (nom et adresse)] Any guarantee we offer is in addition to your statutory rights, never instead of them.
Your statutory rights are explained on our Returns page. »
10. Safe use
The chair is designed for feeding and stories while you're awake. Please follow The Lullaby Trust's safer-sleep advice: don't fall asleep with your baby in an armchair or on a sofa. Once your baby is crawling, keep them clear of the runners. Follow the assembly and care instructions supplied with the chair.
11. Our responsibility for loss or damage
- If we break these terms or fail to use reasonable care and skill, we're responsible for loss or damage you suffer that is a foreseeable result. Loss or damage is foreseeable if it's obvious that it will happen, or if we both knew it might happen when the contract was made.
- We don't exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your legal rights in relation to the chair, as summarised in section 8.
- We sell for domestic and private use only. We aren't liable to you for any loss of profit, loss of business or business interruption.
- If we're assembling or delivering into your home, we'll make good any damage to your property that we cause.
12. Events outside our control
We aren't responsible for delays caused by events outside our reasonable control, such as severe weather, a carrier's failure or a disruption to supply. If this happens, we'll tell you as soon as possible and do what we can to limit the delay. If the delay is likely to be long, you can cancel and we'll refund you in full for anything you've paid and not received.
13. Complaints and disputes
If you're unhappy, please contact us first at [CONFIRM : SAV-01 · adresse e-mail du service client]. We'll acknowledge your complaint within [CONFIRM : SAV-04 · délai de réponse réel] and try to put things right.
14. Your personal data
We use your personal data as set out in our Privacy Policy.
15. Other important terms
- We may transfer our rights and obligations under these terms to another organisation. We'll tell you if this happens and make sure it doesn't affect your rights.
- You need our consent to transfer your rights to someone else.
- These terms are between you and us. No one else has rights under them.
- If a court finds part of these terms unlawful, the rest will continue in force.
- If we don't insist straight away that you do something you're required to do, we can still require you to do it later.
16. Which laws apply and where you can bring proceedings
These terms are governed by the law of [CONFIRM : LEG-01 · droit applicable et juridiction, selon le lieu d'immatriculation de l'entité (England and Wales, Scotland ou Northern Ireland)]. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you can bring them in Scotland or England and Wales. If you live in Northern Ireland, you can bring them in Northern Ireland or England and Wales.
17. Changes to these terms
We may update these terms from time to time. The version that applies to your order is the one published when you placed it. You'll find it attached to your order confirmation email.
